SHIPPING METHODS, COSTS AND DELIVERY TIMES

Shipments will be made via GLS courier. Orders are processed and shipped during our business hours: Monday-Friday from 9:00 a.m. to 6:00 p.m. GMT+1 (except for public holidays recognised in Italy). Goods will only be ready for shipment after payment has been received. All shipments from www.ferodaprua.it are insured against theft or damage. If you receive a visibly damaged package, please do not accept it and leave it with the courier.

Please note: once you have collected the delivery in person and confirmed it with your signature, the insurance cover expires.

GLS shipping is only available within Italy.

SHIPEMENT TRACKING

Once the order has been shipped on www.ferodaprua.it, FDP S.r.l. will provide the GLS tracking details for the parcel via email.

You can track the status of your shipment by clicking on the link and entering the tracking number.

GENERAL TERMS AND CONDITIONS

This document sets out the general terms and conditions of sale and online payment via the website corresponding to the domain name www.ferodaprua.it, owned and managed by FDP srl, with registered office in Via delle Industrie, 43 – 30020 Fossalta di Piave (VE), VAT number and tax code 04767610274, registered with the Venice Companies Register under number VE – 448917.

These general terms and conditions (‘General Terms and Conditions’), except for any exceptions specifically agreed in writing, govern the relationship between FDP srl and the customer, whether a consumer or a professional (‘customer’).

CONCLUSION OF THE CONTRACT

1) The contract between FDP srl and the customer shall be deemed concluded upon acceptance of the order by FDP srl and, in any case, subject to successful completion of the relevant payment. By completing the online order form, the customer declares that they have read all the information provided during the purchase process and fully accept the General Terms and Conditions set out below.

2) Once the online purchase procedure has been completed, the customer shall print or save an electronic copy and in any case retain these General Terms and Conditions and, if the customer is a consumer, also in compliance with the provisions of Articles 52 and 53 of Legislative Decree No. 206 of 6 September 2005 (‘Legislative Decree No. 206/2005’) .

HOW TO PURCHASE

3) Customers may only purchase online products listed in the electronic catalogue published on the Website (‘Products’) and indicated as available at the time the order is placed, as described in the relevant information sheets available on the Website. It is understood that the measurements, weights, dimensions and performance indicated in the information sheet are approximate values and that the image accompanying the description of a Product may not be perfectly representative of its characteristics but may differ in colour, dimensions, components and/or accessories shown in the picture.

4) Order receipt is confirmed by Alessandro Bertacco and Riccardo Mariuzzo on behalf of FDP srl, by means of an email reply sent to the email address provided by the customer when registering in the reserved area of the Website or when filling in the electronic form relating to the transmission of the order. This confirmation message will include the date and time of receipt of the order and a “Customer Order Number”, to be used in all further communications with Bertacco A. and Mariuzzo R. on behalf of FDP srl. The reply message from the partners on behalf of FDP srl will contain a summary of the order placed, all the data entered by the customer and the General Terms and Conditions. The customer undertakes to verify its correctness and to promptly communicate any corrections, according to the procedures described in the message itself.

5) If, for any reason, FDP srl is unable to fulfil the customer’s order, the customer will be notified by email.

CORRESPONDING AMOUNT

6) The price for the purchase of the Products is that communicated to the customer directly by Bertacco A. and Mariuzzo R. on behalf of FDP srl through the Website itself and summarised in its total amount in the shopping cart.

Payment may be made by the customer using one of the methods indicated below.

PAYMENT METHODS

7) The prices of the products on the website are inclusive of taxes, VAT and shipping costs.

8) The following payment methods are available:
• Payment via PayPal, Google Pay, Apple Pay, Visa, Maestro and Mastercard
(a) When using the PayPal card payment method, the customer can pay for the order directly through their verified PayPal account. FDP srl informs that only payments made from verified accounts will be accepted and reserves the right to ship the Products ordered by the customer to the address indicated on the verified PayPal account.
(b) Payments for Product orders from unverified PayPal accounts will be cancelled and, consequently, will not be processed by FDP srl.

DELIVERY METHODS AND COSTS – INVOICING

9) The Products ordered will be sent to the address indicated by the customer when registering in the reserved area of the Website or, if different, to the address indicated in the relevant order. The delivery status of the order will be visible to the customer by accessing the Website and consulting the area reserved for purchase history.

10) For each order placed on the website www.ferodaprua.it, FDP srl will issue an invoice for the Products shipped, sending it both by email to the person who placed the order, in accordance with Article 14 of Presidential Decree 445/2000, and including it in the package containing the Products. For the issuance and preparation of the invoice, the information provided by the customer in the order form and at the time of registration in the reserved area of the Website shall be considered authentic. Once the invoice has been issued, it will not be possible to make any changes to the data entered therein.

11) Delivery costs, as specified on the Website and in the order text, are borne by the customer.

12) Orders will be shipped on weekdays, from Monday to Friday. Orders placed on Saturdays, Sundays, or other holidays or days preceding holidays will be processed by FDP srl starting from the first working day following the day on which they were placed.

13) The delivery of the Products ordered to the customer will be carried out by GLS courier. FDP srl cannot be held liable for any delays in the delivery of the order.

14) Customers can check the progress and shipping status of their orders at any time by accessing the reserved area of the Website or the link to the website of the chosen courier, using the “Customer Order Number” assigned at the time of order confirmation and the “Tracking Number” (or similar tool) assigned to each individual shipment.

15) FDP srl’s contractual obligation to the customer is deemed to have been fulfilled at the place where the Products purchased by the latter are delivered by FDP srl to the chosen courier.
Delivery by the courier of the Product ordered is understood to be at the customer’s street level, unless otherwise communicated by Customer Service.

16) Upon delivery of the purchased Product by the courier, the customer is required to check:
•that the number of packages delivered corresponds to that indicated in the transport document sent in advance by email
•that the packaging is intact, undamaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or the Product or any discrepancy in the number of packages or indications must be immediately reported by the customer, by writing ‘RESERVE OF CONTROL’ (SPECIFYING THE REASON FOR THE RESERVE, e.g. ‘damaged packaging’, ‘crushed packaging’, etc.) on the courier’s proof of delivery. Once the courier’s document has been signed, the customer may not make any objection regarding the external characteristics of the goods delivered.

Any problems relating to the physical integrity, correspondence or completeness of the Products received must be reported within 14 days of receipt of the order, in accordance with the procedures set out in these general terms and conditions.

CUSTOMER’S RIGHT OF WITHDRAWAL

17) Pursuant to Article 64 of Legislative Decree No. 206/2005, customers who qualify as consumers have the right to withdraw from the purchase contract for any reason, without providing explanations and without penalty, in accordance with the terms and conditions set out in the following articles.

18) To exercise the right of withdrawal referred to in Article 18 above, the customer must send a notice to this effect to Alessandro Bertacco and Mariuzzo Riccardo on behalf of FDP srl within 14 days of receiving the Products for which the right of withdrawal is being exercised. This notice may be sent by writing to ciao@ferodaprua.it.

19) Once the aforementioned notice of withdrawal has been received, the customer will be promptly provided with instructions on how to return the product. The returned product must be received by FDP srl within 14 days of receipt of the aforementioned RMA authorisation. The date of delivery to the post office or courier will be considered valid for this purpos

20) The purchased Product must be returned intact, unused, unwashed and otherwise unaltered, complete with all its parts, in its original packaging (including original packaging and boxes, and any accessory material). To limit damage to the original packaging, we recommend placing it in a second box, on which you should affix the label provided by FDP srl; in all cases, avoid affixing labels or adhesive tape directly to the original product packaging.

21) Shipping costs for returning the product are borne by the customer; delivery costs to the customer and any other additional costs and/or taxes highlighted at the time of placing the order will not be refunded.
The shipment, until proof of receipt in the FDP srl warehouse, is under the complete responsibility of the customer.

22) The right of withdrawal applies exclusively to the Product purchased in its entirety; it is not possible to exercise withdrawal only on one or more parts of the Product purchased. In the case of orders comprising several Products, it will be possible to exercise withdrawal in relation to one or more Products of the order, specifying the description of the Products to be returned in the withdrawal notice, in accordance with Article 19 above.
In the event of damage to the Product during transport, FDP srl will notify the customer of the incident (within 5 working days of receipt of the Product in its warehouses), to enable them to promptly file a complaint against the courier and obtain a refund of the value of the Product (if insured); in this case, the Product will be made available to the customer for return, simultaneously cancelling the request for withdrawal.
FDP srl is not liable in any way for damage or theft/loss of the Products.
Upon arrival at the FDP srl warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original packaging and/or wrapping is damaged, FDP srl will deduct the costs from the refund.

23) Without prejudice to any repair costs for damage to the original packaging, FDP srl will refund the customer the amount already paid for the purchase of the Product within 14 days of its return. The refund will be made by reversing the amount charged to your PayPal or Satispay card or to your account via the Stripe service.

24) The customer forfeits the right to exercise the right of withdrawal due to the lack of the essential condition of integrity of the Product (packaging and/or its contents) in cases where FDP srl ascertains:
•the use, even partial, of the Product and any accessories;
•the absence of the external packaging and/or original internal packaging and/or labels of the garment;
•the absence of integral parts of the Product;
•the absence of the control tag attached to the Product;
•damage to the Product for reasons other than transport.
In such cases, the Products will remain in storage at the FDP srl warehouse, available for collection by the customer at their own expense.

GUARANTEES

25) All Products sold through the website are covered by the manufacturer’s warranty for conformity defects, lasting 12 months if the customer is a professional operator (and, as such, has a VAT number) and lasting 24 months if the customer is a consumer, as provided for by Legislative Decree no. 206/2005.

26) The manufacturer’s warranty is provided in accordance with the law.

27) The warranty applies to Products that present a lack of conformity, provided that the Product itself is used correctly, in accordance with its intended use and the provisions of the accompanying documentation. In the event of a lack of conformity, FDP srl will, at no cost to the customer, restore the conformity of the Product by repair/replacement or price reduction or termination of the contract. If, following an inspection by FDP srl, the defect is not found to be a lack of conformity, the customer will be charged for any inspection and repair costs, where applicable, as well as transport costs if incurred by FDP srl.

28) If, for any reason, FDP srl is unable to provide its customer with a Product under warranty (repaired or replaced), it may, at its discretion, refund the amount paid, taking into account the use of the Product, or replace it with a Product of equal or superior characteristics.

29) The time required to repair or replace a defective Product depends exclusively on the manufacturer’s policies, and no damages may be claimed from FDP srl for any delays in carrying out repairs or replacements.

30) In cases where the application of the guarantees provides for the return of the Product, the same must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories). In order to limit damage to the original packaging, FDP srl recommends placing it in a second box.

PERSONAL DATA PROTECTION

31) Pursuant to Article 13 of Legislative Decree 196/2003 and subsequent amendments and additions, FDP srl, as Data Controller, informs the customer that the personal data provided by the customer and acquired at the same time (i) upon registration in the restricted access area of the Website, (ii) when concluding an online purchase contract through the Website www.ferodaprua.it for any product, (iii) when browsing the Website through the so-called system ‘logs’, will be processed using manual, computerised and telematic tools for the purposes indicated below:
• the performance by FDP srl of the activities necessary for the conclusion, management and execution of contracts for the purchase of products through the Website owned by it;
• for purposes strictly connected with and/or necessary to satisfy requests made from time to time by the user through the Website or by email or other means of communication;
• the fulfilment of obligations under laws, regulations and EU legislation, as well as provisions issued by authorities legitimated by law or by supervisory and control bodies;
• sending newsletters and promotional material concerning the products offered by Alessandro Bertacco and Mariuzzo Riccardo on behalf of FDP srl.

With reference to the purposes indicated above, FDP srl informs you that the provision of data is mandatory for purposes 1), 2) and 3), with the consequence that, in such cases, any refusal to provide data will make it impossible for FDP srl to satisfy and process customer orders or requests.

In view of the above, with reference to the processing referred to in point 4) above, FDP srl will ask the customer from time to time, through specific forms on the Website, to give their consent to this type of processing.

Personal data is processed using methods strictly related to the purposes indicated above and, in any case, in such a way as to guarantee the security and confidentiality of the data. Furthermore, personal data may be communicated – for the purposes referred to in points 1), 2) and 3) – to parties other than FDP srl, who will process it as independent data controllers or data processors. In any case, personal data will not be disclosed.

The data will be stored within the EU

Finally, FDP srl informs you that Article 7 of Legislative Decree 196/2003 grants customers who provide their personal data specific rights, including the right to obtain from the data controller or data processor, where appointed, confirmation of the existence or otherwise of their personal data and that such data be made available to them in an intelligible form, to know the origin of the data and the logic and purposes on which the processing is based, to obtain the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as the updating, rectification or, if interested, integration of the data; to object, for legitimate reasons, to the processing itself.

In order to be aware of any changes or modifications to the policies relating to the protection of personal data followed by FDP srl, mainly due to regulatory changes, customers are advised to consult this document on a regular basis.

33) These General Terms and Conditions are governed exclusively by Italian law.

AGREE

Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, we hereby expressly accept the provisions of Articles: 3 (brief description of the Products in the catalogue); 5 (right not to fulfil the order); 8.1, letter e (no liability for fraudulent use of Customers’ credit cards); 8.1, letter f (no liability for the successful completion of online payments); 8.2, letter b (reservation to cancel the order if a copy of the bank transfer is not received within 48 hours); 8.3, letter b (reservation to cancel the order in the case of payments from unverified PayPal accounts); 11 and 22 (delivery/shipping costs and taxes payable by the customer); 15 (fulfilment of FDP srl’s obligations upon delivery of the Product to the chosen carrier); 16 (responsibility of the customer to check the Products delivered); 17 (unconditional acceptance of the Product by the customer, in the absence of complaints); 23 (10% charge in the event of damage to the returned Product); 25 (right to refuse acceptance of the returned product); 32 (privacy) and 34 (applicable law) of these General Terms and Conditions.
